Welcome to Dreamgraphy. These Terms & Conditions govern your use of the Dreamgraphy website, our booking process, and the general policies that apply when you inquire about or book photography services through Dreamgraphy.

Please read these Terms carefully before using our website or booking a session. By accessing this website, submitting an inquiry, booking a session, making a payment, or otherwise using Dreamgraphy’s services, you agree to these Terms. If you do not agree with these Terms, please do not use this website or book services through Dreamgraphy.

1. About Dreamgraphy

Dreamgraphy provides access to photography session experiences through a curated network of professional photographers. Dreamgraphy assists with the booking process, session coordination, photographer matching, customer support, and gallery delivery process.

Photographers who provide sessions through Dreamgraphy may operate as independent contractors. Each photographer brings their own artistic style, approach, and professional judgment while working within Dreamgraphy’s overall standards and client experience process.

2. Website Use

The Dreamgraphy website is provided for informational, booking, and customer-service purposes. You agree to use this website only for lawful purposes and in a way that does not interfere with the website’s functionality, security, or availability.

You may not use this website to:

submit false, misleading, or fraudulent information;
interfere with or disrupt website operation;
copy, scrape, reproduce, or misuse website content;
attempt unauthorized access to Dreamgraphy systems, accounts, or data;
use Dreamgraphy content, images, copy, or branding without permission.

Dreamgraphy reserves the right to restrict access to the website or services if we believe a user is violating these Terms or misusing the website.

3. Booking Requests and Session Confirmation

Submitting a booking request does not automatically confirm your session. Dreamgraphy must review your requested date, time, location, session type, package, and photographer availability before the booking is finalized.

A session is considered confirmed only after:

photographer availability has been confirmed;
any applicable booking details have been reviewed;
payment has been received according to the applicable payment terms; and
Dreamgraphy or its booking system has confirmed the session.

If your requested photographer is unavailable, Dreamgraphy may offer an alternative photographer when possible. You are not required to accept a substitute photographer unless otherwise agreed in your specific booking agreement.

4. Services and Package Details

Dreamgraphy offers photography sessions and related services as described on the website, booking pages, invoices, and session agreements. Session packages may include specific session lengths, image quantities, locations, planning support, and gallery delivery details.

Package details, availability, pricing, and inclusions are subject to change. The package terms that apply to your booking are the terms confirmed at the time your session is booked, unless otherwise agreed in writing.

Clients may be able to upgrade services, extend coverage, or purchase add-ons when available. Downgrades after booking may not be permitted.

5. Pricing, Payment, and Taxes

All session fees must be paid according to the payment terms provided at booking. Unless otherwise stated, sessions are required to be paid in full after photographer availability is confirmed in order to secure the session.

Prices may be listed in U.S. dollars or another applicable currency depending on the booking location and platform. Applicable taxes, processing fees, or third-party platform fees may be added where required.

Dreamgraphy reserves the right to update pricing at any time. Price changes do not affect already confirmed bookings unless an upgrade, add-on, extension, or additional service is requested after the original booking.

6. Travel Fees, Permits, Parking, and Location Costs

Some session locations may involve an additional travel fee, permit fee, parking fee, toll, extended driving cost, or other location-related expense. These fees may vary by photographer, destination, route, and session location.

When applicable, travel fee information may be displayed on the photographer’s profile page, communicated during the booking process, included in the photographer’s response, or confirmed before the session.

Unless otherwise stated, travel fees are separate from the session package price and are paid directly to the photographer on the day of the session, typically in cash using the local currency of the session location. If the client and photographer mutually agree to another payment method, that arrangement is made directly between the client and photographer.

If a required travel fee or location-related fee is not paid, Dreamgraphy may cancel the session without refund or withhold gallery delivery until the fee is paid, depending on the circumstances and the applicable session agreement.

Clients are responsible for reviewing all travel fee and location information before confirming a booking.

7. Cancellation and Refund Policy

Cancellation terms may vary depending on the booking, package, destination, timing, and session agreement. Unless otherwise stated in your session agreement, the following general cancellation policy applies:

Cancellations received fifteen (15) days or more before the scheduled session date may be eligible for a refund of ninety percent (90%) of the booking fee, with Dreamgraphy retaining ten percent (10%) as an administrative processing fee.
Cancellations received between eight (8) and fourteen (14) days before the scheduled session date may be eligible for a refund of fifty percent (50%) of the booking fee.
Cancellations received seven (7) days or less before the scheduled session date are final and non-refundable.

All cancellation requests must be submitted in writing to info@dreamgraphy.com. The date Dreamgraphy receives the written cancellation request determines the applicable cancellation window.

If a refund is approved, Dreamgraphy will make reasonable efforts to process the refund within ten (10) business days after the refund is confirmed.

Specific terms in a signed client agreement, invoice, booking page, or written confirmation may supplement or control over the general cancellation terms above.

8. Photographer Availability and Substitute Photographers

If an assigned photographer becomes unavailable due to illness, emergency, physical incapacity, travel disruption, or other circumstances outside Dreamgraphy’s reasonable control, Dreamgraphy will make reasonable efforts to notify the client and identify a substitute photographer from the Dreamgraphy network when possible.

If a substitute photographer is offered, Dreamgraphy may provide information about the substitute photographer’s portfolio or style. The client may accept the substitute photographer or decline and cancel the session according to the applicable session agreement.

Dreamgraphy will make reasonable efforts to match clients with a photographer of comparable quality and style, but exact stylistic equivalence cannot be guaranteed.

9. Attendance Limits and Additional Attendee Fees

Session packages may include attendance limits based on the session duration. Unless otherwise stated in your booking or session agreement, the general limits are:

60-minute sessions: up to 10 attendees;
90-minute sessions: up to 15 attendees;
2-hour sessions: up to 20 attendees.

Clients must accurately disclose the expected number of attendees at the time of booking. If the actual number of attendees exceeds the package limit, additional attendee fees may apply.

Unless otherwise stated, the additional attendee fee is $60 USD per person above the applicable package limit. Payment of additional attendee fees does not automatically extend session time or increase the number of delivered images.

Dreamgraphy may withhold final gallery delivery until any additional attendee fees are paid in full.

10. Punctuality, Late Arrivals, Waiting Time, and Session Extensions

Clients are responsible for arriving on time and prepared for the session. Dreamgraphy recommends arriving approximately fifteen (15) minutes early to allow for parking, navigation, traffic, weather, children’s needs, or other delays.

If a client arrives late:

the session will still end at the originally scheduled end time unless the photographer is available and agrees to extend;
missed time is forfeited;
the number of delivered images may be reduced if the session is shortened;
no refund will be provided for lost time caused by client tardiness.

If the photographer is available and the client requests additional time, extensions may be billed at $160 USD per 30-minute increment or portion thereof, unless otherwise stated in the booking terms.

If the client requests that the photographer wait beyond the scheduled session end time due to late arrival or other delay, waiting time may be billed at $50 USD per 15-minute increment or portion thereof.

Dreamgraphy may withhold gallery delivery until any approved extension, waiting-time, or related fees are paid in full.

11. Surprise Proposal and Engagement Sessions

Surprise proposal sessions require additional coordination, planning, timing, discretion, and photographer positioning. If you book a surprise proposal package, Dreamgraphy or the assigned photographer may help coordinate proposal timing, suggested positioning, route flow, and other planning details.

Where applicable, the photographer may provide a proposal plan or recommended sequence of events. Clients are responsible for reviewing the plan, communicating concerns, and following the agreed timeline and instructions as closely as possible.

Dreamgraphy and the photographer will make reasonable efforts to support the proposal plan, but cannot guarantee specific outcomes, reactions, weather conditions, crowd levels, lighting conditions, privacy, or third-party cooperation at public locations.

If a consultation call or planning communication is included and the client declines or cannot participate, no refund will be provided for the unused planning component.

12. Client Responsibilities and Cooperation

Clients agree to cooperate with Dreamgraphy and the assigned photographer before and during the session. This may include providing accurate information, identifying important participants, following location and timing guidance, assisting with group organization, and responding to reasonable planning questions.

Dreamgraphy is not responsible for missed photographs, reduced image quantity, or limited gallery variety caused by lack of cooperation, inaccurate information, late arrival, unresponsive communication, disruptive behavior, or failure to follow reasonable photographer direction.

13. Client Conduct and Safety

Dreamgraphy is committed to creating a respectful, safe, and professional environment for clients and photographers.

Clients and attendees must not engage in harassment, threats, verbal abuse, physical misconduct, unsafe behavior, discriminatory conduct, sexual harassment, or grossly inappropriate behavior.

If a photographer reasonably determines that client or attendee behavior is unsafe, abusive, harassing, or disruptive, the photographer may end the session immediately. In such circumstances, no refund will be provided. If usable images were created before the session ended, the photographer may select and deliver images at their professional discretion, but no minimum image quantity will be guaranteed.

14. Exclusivity of Professional Photography

Dreamgraphy photographers are the professional still photographers assigned to provide the booked session. Clients may not bring or hire another professional photographer to photograph the same session unless Dreamgraphy has approved this in writing in advance.

If another professional photographer is present without approval, Dreamgraphy may treat this as a breach of the session terms and may end the session without refund.

15. Creative Control and Editing Style

Clients acknowledge that photography is a creative service. The assigned photographer and Dreamgraphy retain creative discretion over posing guidance, lighting, composition, cropping, image selection, editing style, color treatment, black-and-white conversions, and final gallery presentation.

Dreamgraphy photographers are not required to provide advanced retouching, body modification, background alteration, object removal, skin manipulation, or extensive Photoshop work. Standard editing generally includes adjustments such as color, exposure, contrast, tone, and overall image polish.

Requests for additional retouching, re-edits, or advanced Photoshop work may be accepted or declined at Dreamgraphy’s discretion and may be billed separately. Unless otherwise stated, advanced retouching may be billed at $300 USD per hour, with a minimum one-hour charge.

16. Image Selection, Gallery Delivery, and Additional Image Purchases

After the session, the photographer will select the best images and edit them according to their professional judgment and Dreamgraphy standards.

Unless delayed by illness, technical issues, force majeure events, or circumstances outside Dreamgraphy’s reasonable control, edited galleries are typically delivered within seven (7) days after the session.

Clients may receive a watermarked selection gallery, from which they choose the number of images included in their package. Once selections are submitted, the selected images will be made available for download without watermark in low-resolution and high-resolution formats.

Clients may have the option to purchase additional images or the full gallery. Unless otherwise stated:

full gallery purchase: $250 USD plus applicable tax;
individual additional images: $30 USD per image.

If one person purchases the full gallery, everyone with access to the gallery may be able to download the images, subject to the gallery permissions and applicable terms.

17. Gallery Access, Downloading, Storage, and Reposting

Online gallery access is provided for twelve (12) months from the date of gallery delivery unless otherwise stated. Clients are solely responsible for downloading, backing up, and safely storing their images during the access period.

After the twelve-month access period, Dreamgraphy may delete the gallery and is not responsible for lost, expired, or undownloaded images.

If a client requests reposting or replacement access after the twelve-month period, and if Dreamgraphy still retains the files, reposting may be treated as a new full gallery purchase and billed at $250 USD plus applicable tax. Dreamgraphy does not guarantee that files will be available after the access period ends.

RAW files are never provided.

18. Complaints, Corrections, and Re-Edit Requests

Clients must notify Dreamgraphy of any issue, discrepancy, technical concern, or complaint regarding the gallery, image quality, image contents, or session coverage within thirty (30) days after gallery delivery.

After the thirty-day period expires, Dreamgraphy is not responsible for corrections, refunds, damages, re-edits, or other remedies relating to the session or gallery.

Any re-edit request submitted after the thirty-day period may be accepted or declined at Dreamgraphy’s discretion and may be billed at the applicable retouching or editing rate.

19. Copyright, Ownership, and Client License

Copyright in the images created during a Dreamgraphy session belongs to the individual photographer who created the images, unless otherwise agreed in writing.

The photographer grants Dreamgraphy the rights necessary to use, display, deliver, promote, publish, and otherwise use the images for Dreamgraphy’s business, portfolio, marketing, advertising, editorial, instructional, social media, and partner-related purposes, subject to applicable law and agreements.

Clients receive a non-exclusive, perpetual license for personal use of the final delivered images. Personal use may include downloading, printing, sharing with family and friends, and posting on personal social media accounts, subject to these Terms.

Clients may not use images for commercial purposes, advertising, resale, profit, business promotion, photographic competitions, or third-party commercial use without written permission.

Clients may not sell, license, alter, filter, heavily edit, or misrepresent the images.

20. Social Media Use

Clients may post properly downloaded final images to personal social media accounts. Clients may not post screenshots of images from watermarked or non-watermarked galleries. Clients should use the download options provided in the gallery for social media posting.

Clients may not apply filters, make additional edits, crop in a way that materially changes the image, or otherwise alter the delivered images when posting.

When posting online, clients are encouraged to credit and tag Dreamgraphy and the photographer.

Dreamgraphy and the photographer may use session images on websites, portfolios, blogs, social media, marketing materials, advertising, editorial features, and other business purposes unless otherwise restricted by written agreement or applicable law.

21. Website Content, Intellectual Property, and Brand Materials

All website content, including text, design, graphics, logos, photographs, videos, icons, page layouts, and other materials, is owned by Dreamgraphy, its photographers, licensors, or content providers and is protected by applicable copyright, trademark, and intellectual property laws.

You may not copy, reproduce, modify, publish, distribute, sell, license, scrape, display, or use Dreamgraphy website content without written permission, except for personal, non-commercial use related to reviewing or booking Dreamgraphy services.

Dreamgraphy’s name, logo, branding, and visual identity may not be used without permission.

22. Feedback, Reviews, and Submitted Content

If you submit feedback, testimonials, reviews, comments, photographs, suggestions, or other content to Dreamgraphy, you grant Dreamgraphy permission to use, reproduce, publish, display, edit, and distribute that content for business, marketing, customer-service, and promotional purposes, unless otherwise restricted by law or written agreement.

You represent that any content you submit is accurate, lawful, and does not infringe the rights of any third party.

23. Third-Party Platforms, Links, and Services

Dreamgraphy may use third-party platforms for booking, payment processing, contracts, scheduling, galleries, email communication, analytics, advertising, customer support, and other business operations.

Dreamgraphy is not responsible for the availability, policies, security practices, errors, outages, or content of third-party platforms or websites. Use of third-party services may be governed by those third parties’ own terms and privacy policies.

Links to third-party websites are provided for convenience and do not imply endorsement.

24. Privacy

Your use of the Dreamgraphy website and services may involve the collection and processing of personal information. Please review Dreamgraphy’s Privacy Policy for information about how we collect, use, share, and protect personal information.

By using the website or booking services, you acknowledge that your information may be processed according to Dreamgraphy’s Privacy Policy.

25. Disclaimers

Dreamgraphy makes reasonable efforts to provide accurate and current information on the website, but we do not guarantee that all website content, pricing, availability, descriptions, or other information will always be complete, current, or error-free.

The website and its content are provided on an “as is” and “as available” basis. Dreamgraphy does not guarantee uninterrupted website access, error-free operation, specific search results, specific booking availability, or specific photographic outcomes.

Photography sessions may be affected by weather, lighting, crowds, public access restrictions, permits, safety conditions, client cooperation, children’s behavior, travel delays, technical issues, or other factors outside Dreamgraphy’s reasonable control.

26. Limitation of Liability

To the fullest extent permitted by law, Dreamgraphy’s total liability for any claim, loss, injury, damage, or dispute arising from or related to the website, booking process, session, gallery, or services is limited to the amount paid by the client to Dreamgraphy for the specific session giving rise to the claim.

Dreamgraphy is not liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost data, lost opportunities, emotional distress, travel costs, replacement costs, or other indirect losses, except where prohibited by law.

In the event of total photographic loss caused by technical malfunction or other issue, Dreamgraphy’s liability will be limited to a refund of the amount paid for the affected session.

27. Indemnification

You agree to indemnify, defend, and hold harmless Dreamgraphy, its photographers, contractors, employees, owners, agents, affiliates, and partners from and against any claims, losses, liabilities, damages, costs, or expenses, including reasonable attorneys’ fees, arising from:

your use of the website;
your booking or participation in a session;
your breach of these Terms;
your violation of law;
your misuse of images or website content;
your conduct or the conduct of attendees you bring to the session;
any information or content you submit to Dreamgraphy.
28. Force Majeure

Dreamgraphy is not responsible for delays, cancellations, non-performance, or failure to deliver services caused by events beyond its reasonable control, including but not limited to severe weather, natural disasters, illness, injury, emergencies, government restrictions, permit issues, transportation disruptions, public safety concerns, technical failures, labor disputes, acts of war, terrorism, civil unrest, or other unforeseen events.

Dreamgraphy will make reasonable efforts to communicate with clients and provide appropriate next steps when such events occur.

29. Governing Law

These Terms and any dispute arising from or relating to the website, booking process, session, services, or these Terms shall be governed by the laws of the State of Hawaiʻi, without regard to conflict-of-law principles, unless otherwise required by applicable law.

Any disputes shall be resolved in the appropriate courts located in Hawaiʻi, unless otherwise required by law or agreed in writing.

30. Changes to These Terms

Dreamgraphy may update these Terms at any time. When updates are made, the “Last Updated” date at the top of this page may be revised.

Your continued use of the website, submission of an inquiry, or booking of services after changes are posted constitutes acceptance of the updated Terms.

Surprise proposal sessions require additional coordination, planning, timing, discretion, and photographer positioning. If you book a surprise proposal package, Dreamgraphy or the assigned photographer may help coordinate proposal timing, suggested positioning, route flow, and other planning details.

Where applicable, the photographer may provide a proposal plan or recommended sequence of events. Clients are responsible for reviewing the plan, communicating concerns, and following the agreed timeline and instructions as closely as possible.

Dreamgraphy and the photographer will make reasonable efforts to support the proposal plan, but cannot guarantee specific outcomes, reactions, weather conditions, crowd levels, lighting conditions, privacy, or third-party cooperation at public locations.

If a consultation call or planning communication is included and the client declines or cannot participate, no refund will be provided for the unused planning component.

12. Client Responsibilities and Cooperation

Clients agree to cooperate with Dreamgraphy and the assigned photographer before and during the session. This may include providing accurate information, identifying important participants, following location and timing guidance, assisting with group organization, and responding to reasonable planning questions.

Dreamgraphy is not responsible for missed photographs, reduced image quantity, or limited gallery variety caused by lack of cooperation, inaccurate information, late arrival, unresponsive communication, disruptive behavior, or failure to follow reasonable photographer direction.

13. Client Conduct and Safety

Dreamgraphy is committed to creating a respectful, safe, and professional environment for clients and photographers.

Clients and attendees must not engage in harassment, threats, verbal abuse, physical misconduct, unsafe behavior, discriminatory conduct, sexual harassment, or grossly inappropriate behavior.

If a photographer reasonably determines that client or attendee behavior is unsafe, abusive, harassing, or disruptive, the photographer may end the session immediately. In such circumstances, no refund will be provided. If usable images were created before the session ended, the photographer may select and deliver images at their professional discretion, but no minimum image quantity will be guaranteed.

14. Exclusivity of Professional Photography

Dreamgraphy photographers are the professional still photographers assigned to provide the booked session. Clients may not bring or hire another professional photographer to photograph the same session unless Dreamgraphy has approved this in writing in advance.

If another professional photographer is present without approval, Dreamgraphy may treat this as a breach of the session terms and may end the session without refund.

15. Creative Control and Editing Style

Clients acknowledge that photography is a creative service. The assigned photographer and Dreamgraphy retain creative discretion over posing guidance, lighting, composition, cropping, image selection, editing style, color treatment, black-and-white conversions, and final gallery presentation.

Dreamgraphy photographers are not required to provide advanced retouching, body modification, background alteration, object removal, skin manipulation, or extensive Photoshop work. Standard editing generally includes adjustments such as color, exposure, contrast, tone, and overall image polish.

Requests for additional retouching, re-edits, or advanced Photoshop work may be accepted or declined at Dreamgraphy’s discretion and may be billed separately. Unless otherwise stated, advanced retouching may be billed at $300 USD per hour, with a minimum one-hour charge.

16. Image Selection, Gallery Delivery, and Additional Image Purchases

After the session, the photographer will select the best images and edit them according to their professional judgment and Dreamgraphy standards.

Unless delayed by illness, technical issues, force majeure events, or circumstances outside Dreamgraphy’s reasonable control, edited galleries are typically delivered within seven (7) days after the session.

Clients may receive a watermarked selection gallery, from which they choose the number of images included in their package. Once selections are submitted, the selected images will be made available for download without watermark in low-resolution and high-resolution formats.

Clients may have the option to purchase additional images or the full gallery. Unless otherwise stated:

full gallery purchase: $250 USD plus applicable tax;
individual additional images: $30 USD per image.

If one person purchases the full gallery, everyone with access to the gallery may be able to download the images, subject to the gallery permissions and applicable terms.

17. Gallery Access, Downloading, Storage, and Reposting

Online gallery access is provided for twelve (12) months from the date of gallery delivery unless otherwise stated. Clients are solely responsible for downloading, backing up, and safely storing their images during the access period.

After the twelve-month access period, Dreamgraphy may delete the gallery and is not responsible for lost, expired, or undownloaded images.

If a client requests reposting or replacement access after the twelve-month period, and if Dreamgraphy still retains the files, reposting may be treated as a new full gallery purchase and billed at $250 USD plus applicable tax. Dreamgraphy does not guarantee that files will be available after the access period ends.

RAW files are never provided.

18. Complaints, Corrections, and Re-Edit Requests

Clients must notify Dreamgraphy of any issue, discrepancy, technical concern, or complaint regarding the gallery, image quality, image contents, or session coverage within thirty (30) days after gallery delivery.

After the thirty-day period expires, Dreamgraphy is not responsible for corrections, refunds, damages, re-edits, or other remedies relating to the session or gallery.

Any re-edit request submitted after the thirty-day period may be accepted or declined at Dreamgraphy’s discretion and may be billed at the applicable retouching or editing rate.

19. Copyright, Ownership, and Client License

Copyright in the images created during a Dreamgraphy session belongs to the individual photographer who created the images, unless otherwise agreed in writing.

The photographer grants Dreamgraphy the rights necessary to use, display, deliver, promote, publish, and otherwise use the images for Dreamgraphy’s business, portfolio, marketing, advertising, editorial, instructional, social media, and partner-related purposes, subject to applicable law and agreements.

Clients receive a non-exclusive, perpetual license for personal use of the final delivered images. Personal use may include downloading, printing, sharing with family and friends, and posting on personal social media accounts, subject to these Terms.

Clients may not use images for commercial purposes, advertising, resale, profit, business promotion, photographic competitions, or third-party commercial use without written permission.

Clients may not sell, license, alter, filter, heavily edit, or misrepresent the images.

20. Social Media Use

Clients may post properly downloaded final images to personal social media accounts. Clients may not post screenshots of images from watermarked or non-watermarked galleries. Clients should use the download options provided in the gallery for social media posting.

Clients may not apply filters, make additional edits, crop in a way that materially changes the image, or otherwise alter the delivered images when posting.

When posting online, clients are encouraged to credit and tag Dreamgraphy and the photographer.

Dreamgraphy and the photographer may use session images on websites, portfolios, blogs, social media, marketing materials, advertising, editorial features, and other business purposes unless otherwise restricted by written agreement or applicable law.

21. Website Content, Intellectual Property, and Brand Materials

All website content, including text, design, graphics, logos, photographs, videos, icons, page layouts, and other materials, is owned by Dreamgraphy, its photographers, licensors, or content providers and is protected by applicable copyright, trademark, and intellectual property laws.

You may not copy, reproduce, modify, publish, distribute, sell, license, scrape, display, or use Dreamgraphy website content without written permission, except for personal, non-commercial use related to reviewing or booking Dreamgraphy services.

Dreamgraphy’s name, logo, branding, and visual identity may not be used without permission.

22. Feedback, Reviews, and Submitted Content

If you submit feedback, testimonials, reviews, comments, photographs, suggestions, or other content to Dreamgraphy, you grant Dreamgraphy permission to use, reproduce, publish, display, edit, and distribute that content for business, marketing, customer-service, and promotional purposes, unless otherwise restricted by law or written agreement.

You represent that any content you submit is accurate, lawful, and does not infringe the rights of any third party.

23. Third-Party Platforms, Links, and Services

Dreamgraphy may use third-party platforms for booking, payment processing, contracts, scheduling, galleries, email communication, analytics, advertising, customer support, and other business operations.

Dreamgraphy is not responsible for the availability, policies, security practices, errors, outages, or content of third-party platforms or websites. Use of third-party services may be governed by those third parties’ own terms and privacy policies.

Links to third-party websites are provided for convenience and do not imply endorsement.

24. Privacy

Your use of the Dreamgraphy website and services may involve the collection and processing of personal information. Please review Dreamgraphy’s Privacy Policy for information about how we collect, use, share, and protect personal information.

By using the website or booking services, you acknowledge that your information may be processed according to Dreamgraphy’s Privacy Policy.

25. Disclaimers

Dreamgraphy makes reasonable efforts to provide accurate and current information on the website, but we do not guarantee that all website content, pricing, availability, descriptions, or other information will always be complete, current, or error-free.

The website and its content are provided on an “as is” and “as available” basis. Dreamgraphy does not guarantee uninterrupted website access, error-free operation, specific search results, specific booking availability, or specific photographic outcomes.

Photography sessions may be affected by weather, lighting, crowds, public access restrictions, permits, safety conditions, client cooperation, children’s behavior, travel delays, technical issues, or other factors outside Dreamgraphy’s reasonable control.

26. Limitation of Liability

To the fullest extent permitted by law, Dreamgraphy’s total liability for any claim, loss, injury, damage, or dispute arising from or related to the website, booking process, session, gallery, or services is limited to the amount paid by the client to Dreamgraphy for the specific session giving rise to the claim.

Dreamgraphy is not liable for indirect, incidental, consequential, special, punitive, or exemplary damages, including lost profits, lost data, lost opportunities, emotional distress, travel costs, replacement costs, or other indirect losses, except where prohibited by law.

In the event of total photographic loss caused by technical malfunction or other issue, Dreamgraphy’s liability will be limited to a refund of the amount paid for the affected session.

27. Indemnification

You agree to indemnify, defend, and hold harmless Dreamgraphy, its photographers, contractors, employees, owners, agents, affiliates, and partners from and against any claims, losses, liabilities, damages, costs, or expenses, including reasonable attorneys’ fees, arising from:

your use of the website;
your booking or participation in a session;
your breach of these Terms;
your violation of law;
your misuse of images or website content;
your conduct or the conduct of attendees you bring to the session;
any information or content you submit to Dreamgraphy.
28. Force Majeure

Dreamgraphy is not responsible for delays, cancellations, non-performance, or failure to deliver services caused by events beyond its reasonable control, including but not limited to severe weather, natural disasters, illness, injury, emergencies, government restrictions, permit issues, transportation disruptions, public safety concerns, technical failures, labor disputes, acts of war, terrorism, civil unrest, or other unforeseen events.

Dreamgraphy will make reasonable efforts to communicate with clients and provide appropriate next steps when such events occur.

29. Governing Law

These Terms and any dispute arising from or relating to the website, booking process, session, services, or these Terms shall be governed by the laws of the State of Hawaiʻi, without regard to conflict-of-law principles, unless otherwise required by applicable law.

Any disputes shall be resolved in the appropriate courts located in Hawaiʻi, unless otherwise required by law or agreed in writing.

30. Changes to These Terms

Dreamgraphy may update these Terms at any time. When updates are made, the “Last Updated” date at the top of this page may be revised.

Your continued use of the website, submission of an inquiry, or booking of services after changes are posted constitutes acceptance of the updated Terms.
